Petitioner has invoked the supervisory jurisdiction of this Court seeking direction upon Partition Officers/Authorities to proceed with and decide the suit for partition of land falling under Survey No. 552 (4K 1M), 385 (16M), 580 (02K 9M), 576 (11M), 584 (1K 09 M), 585 (15M), 586 (15M), 599(1K 9M), 602 (18M), 649 (10M), 709 (1K 12M), 1149 (4M), 1918 (1K 18M), 349 (3K 9M) 350 (16M), 567 (2K 14M), 606 (1K 9M), 607 (1K 3M), 502 (2K 6M) and 597, 598, 600, along with trees, titled ‘Gulzar Ahmad Khan vs. Yaar Mohammad Khan’ which is pending from more than a decade without effective proceedings despite having been transferred from one authority to another and with a direction to decide the matter within a period of two months or such short duration, as the Court may deem proper. 02. Learned counsel for the petitioner submits that the matter regarding partition is at present pending before the Tehsildar Kupwara, in terms of order dated 16th of November, 2023 passed by the Assistant Commissioner (Revenue) Kupwara and that no effective proceedings have been taken by the Tehsildar in the matter as yet. 03. He further submits that the petitioner will be satisfied if this case is disposed of at this stage with a direction to the Tehsildar Kupwara to decide the matter expeditiously. 04. In view of the pleadings of the case, submissions urged at the Bar and the innocuous prayer raised by the learned counsel for the petitioner, the petition is disposed of at this motion stage with a direction to the Tehsildar Kupwara to proceed in the matter of partition proceedings in the case titled ‘Gulzar Ahmad Khan vs. Yaar Mohammad Khan’ expeditiously and conclude the same, preferably, within a period of four months. 05.
