The petitioner is apprehending his arrest in connection with Pakur(T) P.S. Case No. 276/2024, registered under sections 140(1), 140(3), 82(1), 85 read with section 3 (5) of BNS, 2023, pending in the Court of learned Chief Judicial Magistrate, Pakur. 3. Learned counsel for the petitioner submits that petitioner happens to be husband of missing woman and belatedly the F.I.R has been lodged. 4. Learned counsel for the State opposes the prayer and submits that petitioner happens to be husband of missing woman and woman has not been recovered as yet. He further submits that just after eight days of missing of the woman, this petitioner has solemnized second marriage. 5. In view of above and considering that petitioner has not lodged any case with the police about missing of his wife. The mother has lodged the said case and it is strange that just after eight days of missing of the woman, this petitioner has solemnized second marriage. In para 20 of the case diary it has come that in supervision report this fact has been found to be true. ( 2026:JHHC:3223 ) 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is hereby rejected.
