Learned advocate appearing for the petitioner submits that the petitioner is in custody since 11th November, 2025 and has been implicated in the present case on the statement of the co- accused. It has also been submitted that two of the other accused persons allegedly from whom seizure was effected has been granted bail in CRM (NDPS) 452 of 2026 and CRM(NDPS)579 of 2026.
Learned advocate for the State opposes the prayer for bail but is unable to refute the contention that the petitioner’s implication in the present case is because of the statement of the co-accused. It has also been brought to the notice of the Court that there are criminal antecedents of the present petitioner.
However, having regard to the fact that persons from
2 whom seizures were effected are on bail, I am of the view that further detention of the petitioner is also unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Monirul Sk @ Manarul Sk @ Minirul Sk shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District Judge, 5th Court at Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Murshidabad without prior permission of the learned special court.
Accordingly, CRM(NDPS) 531 of 2026 is allowed.
