Heard learned counsel appearing for the parties. 2. In this Writ Petition, the petitioner has sought for writ of mandamus directing the respondent - University to admit the petitioner for the fourth year B.A. LL.B. Course and to permit the petitioner to continue her studies in the respondent No.2 - College. 3. The perusal of the Writ Petition would indicate that the petitioner has committed a malpractice and the Malpractice Cases Consideration Committee has recommended to impose - 3 - HC-KAR NC: 2026:KHC:15189 WP No. 914 of 2026 the punishment as per the Karnataka State Law University Examination Ordinance-2014. Accordingly, the punishment was imposed as per clause C (4) of the aforementioned ordinance. The clause C (4) of the Ordinance reads as under: 4. Possession of Manuscripts / printed material / Xerox copies written on question paper/hand-kerchief/ on scale and on any other material etc. The candidate shall not be allowed to take next one available examination besides forfeiting his/her performance in the examination in which he/she commits malpractice. 4. Learned counsel appearing for the petitioner submitted that, the petitioner herein was already one year away from the college on account of the imposition of the punishment by the respondent - University and therefore she has to be admitted to the 4th year (Seventh Semester) B.A. LL.B. Course in the respondent-College. In this regard, learned counsel appearing for the respondent-University, submitted that the Seventh Semester is an odd Semester and therefore, as and when the odd Semester will begin, the petitioner shall get admitted to the respondent - College. - 4 - HC-KAR NC: 2026:KHC:15189 WP No. 914 of 2026 5. Taking into consideration the language employed in Clause(C)(4) of the Ordinance, 2014, wherein the petitioner shall not be allowed to take the next one examination and also she has to forfeit the Sixth Semester Examination in which she committed malpractice and in that view of the matter, taking into consideration the aforementioned Rule contemplated in the KSLU Examination Ordinance-2014, I am of the view that it is open for the petitioner to get admitted to Sixth Semester which is the even Semester which will be started by the respondent- University. 6.
