THIS APPEAL COMING ON FOR CONCILIATION BEFORE NATIONAL LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED: CONCILIATION ORDER 1. Learned Counsel appearing for the Appellant / Claimant is present. Learned Counsel appearing for Respondent No.2 / Insurance Company along with its representative are present. 2. After detailed negotiations, the matter has been settled between the parties. A joint memo signed by the learned Advocate appearing for the appellant/claimant (being authorized by the appellant/claimant to sign) and the learned Advocate appearing for respondent No.2/Insurance Company and an 3 authorized officer has been filed. The appellant/claimant has agreed to receive and respondent No.2/Insurance Company has agreed to pay a sum of Rs.3,25,000/- (Rupees Three Lakhs Twenty-five Thousand), in addition to what has been awarded by the Tribunal, in full and final settlement of the claim in the following terms: (i) Respondent No.2 / Insurance Company shall release an amount of Rs.2,00,000/- (Rupees Two Lakhs) in favour of the appellant / claimant, immediately; (ii) The balance amount of Rs.1,25,000/- (Rupees One Lakh Twenty-five Thousand) shall be kept in an interest-bearing Fixed Deposit Account, and shall be released in favour of the appellant / claimant after a period of one year. 3. 3. Respondent No.2 / Insurance Company has agreed to deposit the said amount before the Tribunal within six weeks from the date of preparation of award, failing which the said amount shall carry interest at the rate of 9% per annum from the date of default, till the date of deposit. 4 4. The enhanced compensation amount shall be released in favour of the appellant/claimant in terms of the above order, on proper identification. 5. This Miscellaneous First Appeal stands disposed of in terms of the Joint memo.
