1. Applicant seeks regular bail in case arising out of FIR No.0724/2024 dated 30.10.2024, registered at P.S. Dabri, for commission of offence under Section 103(1) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Section 302 IPC). 2. It is a case of robbery accompanied by murder and according to learned APP for the State, one PW-Shakeel is prime-most material witness of the case, as he was present at the spot alongwith the deceased at the time of alleged robbery and murder, and such witness is yet to be examined. 3. The next date of hearing before the learned Trial Court is stated to be

without prejudice to his rights and contentions, seeks to withdraw the present application with liberty to file it afresh once the testimony of PW-Shakeel is recorded by the learned Trial Court. He, however, submits that the prosecution has yet not been able to produce him before the learned Trial Court for recording of his evidence and the Court had to issue Bailable Warrants against him. 5. I.O. is present in the Court and he is directed to ensure that the abovesaid material eye-witness is produced before the learned Trial Court on the abovesaid date. 6. The present application is disposed of as not pressed. 7. Present application also stands disposed of in aforesaid terms. 8. Liberty, as prayed, is granted.
