Learned advocate appearing for the petitioners submits that the petitioners are in custody since 8th September, 2025 and there have been alleged recovery of 21.550 kgs. of ganja from the joint possession of the present petitioners. Charge has already been framed and the prosecution has relied upon 14 witnesses in order to prove its case.
Learned advocate for the State opposes the prayer for bail.
I have taken into account the quantity of seizure, the period of detention and probable time which will be required to take the trial to its logical conclusion. Having considered the same, I am of the view that further detention of the petitioners are unwarranted
2 as some time will be consumed in taking the trial to its logical conclusion.
Accordingly, the prayer for bail of the petitioners is allowed. The petitioners, namely, Jamrul Sk and Samirul Hossain shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional District Judge, 5th Court at Berhampore, Murshidabad. If on bail, the petitioners shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Murshidabad without prior permission of the learned special court.
Accordingly, CRM(NDPS) 545 of 2026 is allowed.
