Issue appropriate Writ in the nature of Mandamus and/or any other appropriate Writ, Order or Direction, thereby directing the Respondent No.1 to set-aside/quash the Suspension Order dated 23rd April, 2026 passed against the Petitioner by the Respondent No.1 and restore the account of the Petitioner on its portal, henceforth; b. issue appropriate writ, order or direction, directing the Respondent No. 1 to frame and implement fair, transparent and judicious guidelines/mechanisms for redressal of grievances of both buyers and sellers on its platform, ensuring that all concerned parties are afforded an adequate and meaningful opportunity of hearing and to present their This is a digitally signed order. The facts of the case would indicate that the GeM Portal account of the petitioner has been suspended for a period of 60 days, disallowing it from participating in fresh tenders. On 20th August, 2025, respondent no.2 had floated a tender on the GeM Portal for the supply of LED Lights and LED Luminaire for supply at respondent no.2 Office at Salem, Tamil Nadu wherein, the petitioner was stated to be the successful bidder (“First Bid”). The said tender was, however, abandoned by respondent no.2, and on 27.10.2025 a fresh tender was floated for the supply of same product, by respondent no.2. The petitioner was, however, disqualified from the said Second Bid. Thereafter, respondent no.2 raised a complaint on respondent no.1’s Portal against the petitioner stating certain discrepancies in the information furnished by the petitioner during the First Bid. In furtherance thereto, a Show Cause Notice dated 06.12.2025 was issued by respondent no.1 to the petitioner, and a detailed response was furnished. 3. The petitioner has filed an appeal on the same date (date of suspension) i.e. on 23.04.2026. The said appeal is still pending. 4. Keeping in mind the overall period of suspension, it would be appropriate to direct the respondent no.2 to decide the petitioner’s appeal within a period of five working days from today. 5. Let the appeal of the petitioner be decided by respondent no.2 on merits within the aforesaid period. If the grievance of the petitioner is not fully mitigated, the petitioner shall be at liberty to file a fresh petition. 6.
