IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2636 of 2026 Sibananda Nayak …. Petitioner(s) Mr. Sandipani Nayak, Advocate -versus- State of Odisha …. Opposite Party(s) Ms. Suvalaxmi Devi, ASC CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 22.04.2026 01. 1. Heard. 2. In the present case, although there is no F.I.R. registered against the petitioner, however, the petitioner is apprehending arrest because he was travelling in a vehicle bearing Regd. No.OD-07-AY-8484 owned by one Mithun Mandal, which met with an accident and a case is pending enquiry. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. The petitioner is neither the owner nor driver of the said vehicle in question. He was only travelling in that vehicle by taking lift. Therefore, he apprehends arrest in the present case. Since there is no F.I.R. registered against the petitioner as yet, the application moved by the petitioner seeking anticipatory bail is not maintainable. 5. Be that as it may, it is directed that in the event the F.I.R. is registered and the petitioner is arrayed as an accused, the Investigating Officer shall serve a written notice before one month in the event of taking any coercive action against the petitioner. 6. With the aforementioned observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Subhasis Designation: Personal Assistant Location: High Court of Orissa, Cuttack.
