Mr. Moyukh Mukherjee Ms. Sagnika Banerjee Ms. Sarmistha Basak …for the Petitioner In this application, learned counsel for the petitioner prays for further direction upon the court below for expeditious disposal of the proceeding being T.R. no. 17 of 2024, presently pending before learned Additional District & Sessions Judge, 1st Court, Purba Medinipur. Learned counsel for the petitioner further submits that the petitioner earlier preferred similar application for a direction upon the court below for expeditious hearing of the case being CRR 717 of 2026, wherein this court directed the court below to fix the next date by 15th March, 2026 and thereafter, the court below was further directed to make his best effort to expedite the trial and if possible, to conduct trial on day-to-day basis and to conclude the entire proceeding preferably within a period of one year from the next date of hearing. On receipt of the order of this court, the Trial Court fixed 13th March, 2026 for examination of the prosecution witnesses and it appears from the record that the court below fixed 30th March, 2026 for recording evidence and six 2 accused persons and one witness, namely Manju Ari were present before the court below on that day but since the Trial court was on SIR duty, the trial could not be conducted and the next date is fixed on 30th April, 2026 for further evidence of PW1. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with. In view of the aforesaid facts and circumstances of this case and that the prayer made by the petitioner is justified, the instant application being CRR 1647 of 2026 is hereby disposed of with a direction upon the court below to comply the earlier order dated 19.02.2026 passed in CRR 717 of 2026 making his best endeavour and to conclude the trial preferably within the date specified in the said order.
