Issue a writ of certiorari or such other writ or order or direction to quash impugned redeployment order 31.03.2026 bearing No.A1 P1 E/3764 K-erp Doc Id 1917066 which is produced and marked as Annexure-A by permitting the petitioner to work in Yelahanka Combine Circle Power Plant with Respect to petitioner concern only. b. Pass such other suitable order or orders as this Hon'ble court deems fit to grant under the facts and circumstances of the case in the interest of justice and equity." - 3 - HC-KAR NC: 2026:KHC:21821 WP No. 10851 of 2026 2. Heard learned counsel for the petitioner and learned counsel for respondent Nos.1 and 2 and perused the material on record. 3. A perusal of the material on record will indicate that the petitioner who is currently working as Assistant Executive Engineer, Yelahanka, Bengaluru has been sought to be redeployed to Kali Hydro Power Station, Dandeli of the respondent by the impugned order for the period commencing from 02.04.2026 to 31.05.2026. 4. It is the grievance of the petitioner that due to health reasons including heart attack, hospitalisation etc., the petitioner is not in a position to travel to Dandeli for the aforesaid period of 2 months and the present petition may be disposed of by directing the petitioner to be redeployed to the aforesaid power station at Dandeli from 01.05.2026 to 30.06.2026 in lieu of the impugned order which is for the period from 02.04.2026 to 31.05.2026 and by reserving liberty in favour of the petitioner to submit a representation ventilating his grievances for the period after 30.06.2026 to be considered by the respondent in accordance with law. - 4 - HC-KAR NC: 2026:KHC:21821 WP No. 10851 of 2026 5. The aforesaid facts and circumstances and the material on record indicates that the petitioner is sought to be redeployed to Hydro Power Station, Dandeli of the respondent for the period from 02.04.2026 to 31.05.2026. However, having regard to the fact that the petitioner has not reported to the said place not only on account of the interim order passed by this Court in the present petition but also on account of health reasons including hospitalisation of the petitioner, I deem it just and appropriate to dispose of this petition directing the petitioner to be redeployed to the Hydro Power Station of the respondent at Dandeli for the period from 02.05.2026 to 30.06.2026 in lieu of the period from 02.04.2026 to 31.05.2026 as per the impugned order. 6. In the result, I pass the following:- ORDER (i) Petition is hereby disposed of directing the petitioner to be redeployed to the Hydro Power Station of the respondent at Dandeli for the period from 02.05.2026 to 30.06.2026 in lieu of the period from 02.04.2026 to 31.05.2026 as per the impugned order. - 5 - HC-KAR NC: 2026:KHC:21821 WP No. 10851 of 2026 (ii) In addition thereto, the petitioner shall submit a representation ventilating his grievances for the period beyond 30.06.2026 having regard to the petitioner attaining the age of superannuation 30.04.2027. (iii) If the petitioner submits such a representation within a period of two weeks from today, the respondent shall consider the same and take appropriate decisions/pass appropriate orders in relation to the petitioner for the period after 30.06.2026 bearing in mind that the petitioner is due to retire and attain the age of superannuation on 30.04.2027 and in accordance with law. (iv) It is made clear that the present order is passed in the peculiar/unique/special facts and circumstances obtaining the instant case and the present order shall not be treated as a precedent nor shall it carry any precedential value for any other purpose whatsoever.
