Daimary, learned counsel appearing for the applicants; Mr. R.K. Talukdar, learned Standing Counsel, Power Grid Corporation for the opposite party nos. 1, 2 & 3; Mr. N. Das, learned Junior Government Advocate, Assam for the opposite party nos. 4 & 5; and Mr. B.C. Musahary, learned Standing Counsel, BTC for the opposite party no. 6. 2. The applicants as the writ petitioners have preferred the accompanying writ petition, W.P.[C] no. 2841/2023 challenging actions on the part of the opposite party nos. 1, 2 & 3 in erecting towers, installation of electricity lines over the lands of the petitioner. 3. The instant application is filed seeking impleadment of the following authority :- ‘the Secretary, Land & Revenue, Bodoland Territorial Council [BTC], BTC Headquarters, Kokrajhar, District – Kokrajhar, Assam.’ as party-respondent no. 7 in the accompanying writ petition. Page No. 3/3 4. It is averred that the presence of the proposed party-respondent no. 7 is necessary for adjudication of the issues raised and involved in the accompanying writ petition. 5. The learned counsel appearing for the opposite parties have submitted that they have no objection if the instant application is allowed. 6. Having regard to the issues raised in the accompanying writ petition, this Court is of the considered view that the presence of the proposed party-respondent no. 7 is a necessary party-respondent. Therefore, the instant application is allowed. 7. The learned counsel for the applicants-writ petitioners is to file an amended Cause-Title in terms of the Notification no. 79 dated 19.06.2023 within 3 [three] working days from today. On submission of the amended Cause-Title, the Registry shall carry out the necessary correction in the Cause-Title as well as in the CIS. JUDGE Comparing Assistant
