Petitioner has filed this writ petition, seeking following reliefs:- “10.1 This Hon’ble Court may kindly be pleased to allow the present writ petition by issuing appropriate writ or direction including the writ of mandamus and directing the respondent to extent the benefit of pension to the petitioner in the interest of justice. 10.2 Any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner, in the interest of justice. 10.3 Cost of the petition may also be granted to petitioner.” 2. Learned counsel for petitioner submits that petitioner was an employee of private educational institute, St. Xavier Higher Secondary School, PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 Ambikapur, which is 100% government aided school and therefore petitioner is entitled for the retiral benefits as being provided to the teachers of the State Government. 3. Learned State counsel opposes the submission of learned counsel for petitioner and would submit that the co-ordinate Bench of this Court in WPS No. 2789/2017 has considered this issue and has dismissed the petitions observing that the teachers/ employee of the private institutions cannot claim retiral benefits at par with the teachers/ employees of the State Government. 4. The above submission made by learned State counsel is not disputed by the counsel for petitioner. 5. I have heard learned counsel for the respective parties. 6. AS the counsel for the respective parties jointly submitted that identical issue has been considered and decided by the co-ordinate Bench of this court in WPS No. 2789/2017 and other connected matters which was disposed of with observation as discussed in preceding paragraph, this writ petition is also dismissed in similar terms as held in WPS No. 2789/2017.
