This criminal appeal under Section 14(2)(A)of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 16.03.2026 passed by the learned Special Judge Scheduled Caste and Scheduled Tribe (Prevention of Atrocities Cases), District Jaipur (Raj.) (hereinafter to be referred as ‘trial court’) in FIR No. 396/2025 registered at Police Station Renwal District Jaipur Rural for the offence under Sections 109(1), 115(2), 126(2), 191(2), [2026:RJ-JP:23763] (2 of 3) [CRLAS-685/2026] 191(3) and 307 of B.N.S., 2023 whereby the trial court has dismissed the bail application filed on behalf of the appellant. 2. Heard the learned counsel for the appellant, learned Public Prosecutor as well as learned counsel for the complainant and perused the material on record. 3. Learned counsel for the appellant submits that the appellant has falsely been implicated in this case. Learned counsel for the appellant further submits that as per the injury report dated 01.01.2026, the injured Ashok sustained 11 injuries, however, out of the said 11 injuries, only three injuries have been opined to be grievous in nature and those injuries are not on the vital part of the body. The remaining injuries have been found to be simple in nature. It is further submitted that there is no medical opinion on record to suggest that any of the injuries were dangerous to life. The appellant is in custody since 27.02.2026. Charge-sheet has been filed though six cases have been reported against him but in all the cases, he is already on the bail. Therefore, the appeal presented by the present appellant may be allowed. 4. Learned counsel for the complainant and learned Public Prosecutor have vehemently opposed the appeal. 5. Considering the facts and circumstances of the case and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellants under Section 14-A(2) of SC/ST Act. 6. Accordingly, this criminal appeal filed under Section 14(2)(A) of SC/ST Act is allowed and order dated 16.03.2026 passed by the [2026:RJ-JP:23763] (3 of 3) [CRLAS-685/2026] learned trial court is set aside. It is directed that appellant- Mukesh Kumar Yadav S/o Shri Sharwan Lal Yadav shall be released on bail provided he shall execute a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
