This application has been filed for grant of regular bail to the petitioner in connection with Sessions Trial No.368 of 2025, arising out of Gandey P.S. case No.33 of 2025, registered for the offence under sections 103(1) and 238 of BNS, 2023, pending in court of learned Additional Sessions Judge-II, Giridih. 3. The learned counsel appearing for the petitioner submits that the petitioner happened to be husband of the deceased and initially the FIR has been registered under section 103(1) of BNS, 2023, however, the charge sheet has been submitted under section 108 of BNS, 2023. He next submits that the altercation took place between the husband and wife on the spur of moment and she has left the house and she was found dead. He next submits that the 2 petitioner is in custody since 25.05.2025 and the petitioner is having a child of 21 months and he is being looked after the family members of the petitioner. 4. The learned counsel appearing on behalf of the respondent State opposed the prayer of regular bail of the petitioner and submits that the petitioner is the husband. 5. Considering that the petitioner happened to be husband and initially the FIR has been registered under section 103(1) of BNS, 2023, however, the charge sheet has been submitted under section 108 of BNS, 2023 and the altercation took place between the husband and wife on the spur of moment and she has left the house and she was found dead and the petitioner is in custody since 25.05.2025, I am inclined to grant regular bail to the petitioner. 6. Accordingly, petitioner, above named, is hereby directed to be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Sessions Judge-II, Giridih, in connection with Gandey P.S. case No.33 of 2025.
