GP FOR SERVICES II The Court made the following: Whether the order is : Speaking Yes/No / Reasoned Yes/No Reportable Yes/No / Non-Reportable Yes/No 3 HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.30102 of 2025 O R DE R: This writ petition is filed directing the Respondents to pay the minimum Time Scale of Rs.25,087/- per month as per G.O.Ms.No.142, Finance (HR.IPIG & Policy) Department, dated 27.08.2018 and also as per proceedings dated 01.11.2022 as illegal and arbitrary. 2. Petitioner is working as Supplier and Cleaner in Respondent No.3-College on daily wage basis from 1993 and has been paid Rs.10,000/- from 16.09.2013 as per Memo No.B1/18028/2012, dated 16.09.2013 issued by Respondent No.2. Thereafter, Respondent No.3 has paid Minimum Time Scale of Rs.24,524/- and from July, 2023 a sum of Rs.25,087/- was paid as monthly salary. However, from September, 2023, without issuing any notice, Respondent No.3 reduced the salary to Rs.10,000/- per month. Government has issued G.O.Ms.No.142, dated 27.08.2018 to pay Minimum Time Scale in the revised pay scales of 2015 to Full time/NMR/Daily Wages/Consolidated Pay/Part Time Employees who were 4 appointed before cut-off date of 25.11.1993. In spite of repeated representations, the case of the Petitioner was not considered for extending the benefit of Minimum Time Scale. Hence, the present writ petition. 3. This Court passed a detailed interim order on 04.11.2025 directing the Respondents to pay Minimum Time Scale of Rs.25,087/- per month to the Petitioner. Reliance was also placed on a judgment of this Court in W.P.No.589 of 2024. 4. A counter affidavit is filed stating that there is no proof that Petitioner joined service before cut-off date of 25.11.1993 as prescribed in G.O.Ms.No.142, dated 27.08.2018. 5. Heard Sri T.Balaji, learned counsel for the Petitioner and learned Government Pleader for Services-II. 6. The issue of extension of Minimum Time Scale in the revised pay scales of 2015 to the Full-time/NMR/Daily wages/Consolidated Pay/Part-time employees who were appointed before 25.11.1993 was examined by group of Ministers Committee. Pursuant to the recommendations by the Group of Ministers, Government issued G.O.Ms.No.142, Finance (HR.I- Pig. & Policy) Department, dated 27.08.2018 to pay Minimum 5 Time Scale in the revised pay scales of 2015 to Full time/NMR/Daily Wages/Consolidated Pay/Part Time Employees who were appointed before cut-off date of 25.11.1993. 7. Petitioner was appointed on 01.11.1993 as per the letters of the Principal of Respondent No.3-College dated 20.05.2011, 07.06.2013 and April, 2022. But there is no specific denial with regard to these letters in the counter affidavit. Therefore, in the absence of any dispute to the correctness with regard to date of appointment of the Petitioner, denial of Minimum Time Scale to the Petitioner cannot be sustained. 8. Therefore, the writ petition is disposed of directing the Respondents to extend the benefit of Minimum Time Scale to the Petitioner from September, 2023 onwards as per G.O.Ms.No.142, dated 27.08.2018 within a period of three months from the date of receipt of a copy of this order.
