Counsel for the petitioner submits that, during the execution proceedings, possession of the rented premises has already been taken from the petitioner, therefore, challenge to the order dated 04.05.2026 has rendered infructuous. Hence, petitioner does not want to press this petition. However, counsel further submits that the petitioner deposited the entire rent in advance in terms of the compromise arrived at between the parties, and despite the same, respondents have arbitrarily obtained possession of the rented premises in execution prior to 13.08.2029.
