The present petition has been filed by the petitioner with the following prayer: "10.1 That, this Hon'ble Court may kindly be pleased to allow this petition and may further be pleased to quash the criminal complaint case No. 32/Child Labour Cases/2025 dated 06.06.2024 filed by Respondent No. 2 pending before the court of learned IInd District and Additional Sessions Judge (For exclusive Labour Court Cases), Rajnandgaon (C.G.); and 10.2 That this Hon'ble Court may kindly be pleased to set aside/quash the order of cognizance and summons order dated 21.04.2025 in criminal complaint case No.32/Child Labour Cases/2025, passed by the learned IInd District and Additional Sessions Judge (For exclusive Labour Court Cases), Rajnandgaon (C.G.); and 10.3 That this Hon'ble Court may kindly be pleased to set aside/quash the order of issuance of the arrest warrant passed by the Ld. Labour Court vide order dated 02.02.2026 in criminal complaint case No. 32/Child Labour Cases/2025, passed by the learned IInd District and Additional 3 Sessions Judge (For exclusive Labour Court Cases), Rajnandgaon (C.G.); and 10.4 That this Hon'ble Court may kindly be pleased to quash all consequent proceedings against the present Petitioner arising out of the criminal complaint case No. 32/Child Labour Cases/2025, and pending before the learned IInd District and Additional Sessions Judge (For exclusive Labour Court Cases), Rajnandgaon (C.G.); and 10.5 Any other relief or relief(s) which this Hon'ble Court may deem fit and proper in view of the facts and circumstances of the case, may also kindly be granted." 3. At the time of hearing, this Court observed that the petitioner had filed the present petition without mentioning the proper Act and Rules in the prayer, therefore, the petition is defective one. 4. In such a situation, learned counsel for the petitioner seeks permission to withdraw the present petition, with liberty to file a fresh petition with a proper prayer. 5. Accordingly, the present petition is dismissed as withdrawn with liberty to file petition afresh with proper prayer, subject to depositing a sum of Rs. 15,000/- as cost by petitioner in the Registry of this Court, 4 the same shall be transmitted to the Government Girls Observation Home, District-Rajnandgaon. 6. Certified copy of the annexures, if any, be returned to the learned counsel for the petitioner after retaining the attested true copy of the same.
