Learned advocate for the petitioner submits that the petitioner is in custody for about 80 days and the investigation having been concluded, further detention of the present petitioner is unwarranted. I have taken into account the statement of the victim who is a three year child. Her statement before the learned Magistrate is consistent and is different from the statement of her mother. Having considered the statement of the victim, at this stage, I am not inclined to release the petitioner on bail. Learned trial court would expedite the process, record the evidence of the 2 victim within a month from the date of consideration of charges and thereafter release the petitioner on bail. With the aforesaid observations, CRM(M)570 of 2026 is disposed of. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
