Petitioner was engaged as Instructor (Fitter) in a Government ITI, on 15.09.2015. It is his case that he is serving continuously thereafter to the satisfaction of all concerned. In this writ petition, petitioner has challenged the order dated 22.06.2026, passed by President, IMC Society, Kamoli-Dhokane, Nainital, whereby petitioner has been informed that the vacancy against which he was engaged, has been filled by regular appointment and his engagement will come to an end on 22.08.2026. 4. Petitioner contends that there is no deficiency found in his work and conduct; he was sent for five days’ training to Salt Lake, Kolkata in the State of West Bengal, on 29.07.2026; there are sufficient vacancies available on the post of Instructor (Fitter) in different Government ITIs within State of UKHC010145582026 2026:UHC:7360 Uttarakhand, therefore, petitioner can very well be accommodated in other Government ITIs. 5. This Court do not find any reason to interfere with the impugned order dated 22.06.2026, as after regular appointment on the vacancy against which petitioner was given contractual appointment, he cannot be retained on the same post. 6. However, having regard to the fact that petitioner has rendered long services on the post of Instructor (Fitter), the writ petition is disposed of with liberty to petitioner to make representation to respondent no. 2. If he makes representation within 48 hours from today, decision thereupon shall be taken, as per law within three weeks thereafter.
