Also heard learned Public Prosecutor for the State. This is an application filed under Section 483 of BNSS, 2023 for granting bail to the petitioner who was arrested and forwarded before the Learned Chief Judicial Magistrate, Kamrup(M), Guwahati Page No.# 2/2 on 25.05.2026, in connection with Basistha P.S. Case No. 161/2026 under Section 127(1)/117(2)/103(1) of BNS, 2023. The brief fact of the case is that the petitioner was arrested on 25.05.2026 and the learned counsel for the petitioner drawing attention to another FIR 15.05.2026 lodged by the present petitioner with the allegation that on that date at around 9.45 pm when he was driving his swift vehicle towards Lalmati, the TATA vehicle driven in high speed collided with his car causing some damage and when he told the driver to be careful, the driver who was in intoxicated state rushed towards him and misbehaved and subsequently, two sons also came rushing and manhandled him. It is submitted by the learned counsel for the petitioner that an altercation took place between the petitioner and the deceased as a result of a road accident, following which the deceased fell down and sustained injuries. In this regard, the petitioner had also lodged an FIR on the same day, which was received by the police, but no case was registered. The Case Diary called for has been received. The FSL report has ruled out any poisoning. As per the medical report, it appears that the deceased sustained multiple injuries on his body, including on his head, as well as a fracture of the ribs. The statement of the doctor also indicates that the deceased died as a result of a head injury. Having regard to the gravity of the offence, the prayer for bail stands rejected at this stage.
