The services of the petitioner as a Teacher was terminated on the ground that B.Ed. which the petitioner has obtained was not from a formally recognized institution. 3. Learned counsel for the respondent -State after going through the counter affidavit and Annexure-21 of the writ petition admits that the institution from where the petitioner has passed B.Ed. is recognized by the NCTE. 4. Learned counsel appearing on behalf of the respondent-NCTE also submits that the institution which conferred the B.Ed. degree to the petitioner is a recognized institution. 5. Considering the facts, which the respondents admits after going through the documents, I am of the opinion that respondents have erroneously terminated the service of the petitioner. Thus, the impugned order dated 23.09.2019 is set aside. 6. The respondents are directed to reinstate the petitioner in service and extend all the consequential benefits. The period which the petitioner was out of service will be considered for his post-retiral benefits. This period will not be treated as break in service. 7.
