1. This revisional application seeks expeditious disposal of Title Suit No. 790 of 2022 pending before the learned Civil Judge (Senior Division), 10th Court at Alipore.
2. In view of the nature of the order proposed to be passed by this Court, direction for prior service of copy of the revisional application along with notice on the opposite party is not being made, however, the petitioners shall remain obliged to serve a copy of this application along with a copy of this order upon the opposite party within a week from date.
3. Learned Advocate appearing for the petitioners submits that the petitioner no.1 is an octogenarian and the petitioner no.2 is a septuagenarian. It is submitted that at one point of time, the records of the learned Trial Court had gone missing whereupon, the same had to be reconstructed. It is further submitted that after such reconstruction, the original records could also be
2 traced but in all this, a lot of time got consumed and the petitioners who are almost in the last legs of their lives still remain languishing.
4. The learned Trial Court is requested to take into consideration the peculiar facts of the case and to endeavour to dispose of the suit as early as the business of the learned Court would permit, by fixing appropriate short and firm dates keeping in mind the age of the plaintiffs.
5. C.O. 760 of 2026 stands disposed of with the above observations. No costs.
6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
