The Court made the following order : Heard Sri Alladi Radha Krishna, learned counsel for the petitioner, Sri Divya Teja, learned Assistant Government Pleader for Revenue, for respondents 1 to 5. 2. Notice in respect of respondents 6 and 7 is dispensed with since no adverse order affecting their rights or interests is passed. 3. The above writ petition was filed to declare the action of respondent No.3, in trying to mutate the names of respondents 6 and 7 in revenue records in respect of properties in Survey Nos.106/4, 106/7, 107/1, 108/5, 110/2, 111/2, 12, 13/2, 14/1, 14/2, 150/1, 126/2, 131/2, 131/3, 131/4, 18/3, 18/5, 19/2, 37/1, 37/3, 38/6, 38/7, 8/1, 9/1, 9/2, 9/3, 9/4, 14/4, 159/3, 18/2, 111/3, 112/50, 114/4, 125/5, 13/1, 131/6, 132/1, and 135/9, Gadisingupuram Village, and Survey Nos. 172/1, 297/1, 297/10, 297/5, 297/8, 298/2, 298/4, 302/2, 302/9, 303/6, and 317/4 of Pedabuddidi Village, without keeping the same in dispute register, as illegal and arbitrary. 4. Learned counsel for the petitioner would submit that respondent No.3 is attempting to mutate the names of respondents 6 and 7 in Record of Rights (RoR), in respect of the aforementioned properties, pending the suit O.S.No.279 of 2021 on the file of the learned VII Additional District Judge, Visakhapatnam. He would submit that the petitioner made a representation to respondent No.3 vide Ex.P1, requesting the authority to keep the property in dispute register, pending disposal of the suit O.S.No.279 of 2021. 5.
Learned Assistant Government Pleader for Revenue, on instructions, would submit that if any application is filed regarding mutation of the names, respondent No.3 will follow the procedure contemplated in the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short ‘the
Act’) and the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules,
1989. Regarding the dispute register, learned Assistant Government would submit that the Division Bench of this Court, by order dated 21.03.2025, in W.A.No.817 of 2024, clarified the legal position and held that the Tahsildar has no jurisdiction to keep the properties in the dispute register unless a suit is filed challenging the entries made in RoR. 6. Though the petitioner sought different reliefs in the writ petition, during the course of hearing, learned counsel confined his arguments and urged the Court to direct respondent No.3 to follow the due procedure regarding updation of RoR, in respect of the properties referred to supra. 7. Given the above facts and circumstances of the case, without going into the merits of the case, this writ petition is disposed of at the admission stage with the consent of learned counsel on either side, directing respondent No.3 to follow the due procedure contemplated under the Act and the Rules made thereunder, if any application is filed regarding change of mutation, in respect of the aforementioned properties.
