The petitioner is an accused in connection with Simdega P.S. Case No. 98 of 2025, pending in the Court of learned Principal District & Sessions Judge- cum-Special Judge (POCSO), Simdega. It has been alleged that the petitioner had forcibly brought the victim to his house and committed rape upon her. The victim, as a result of the said act of the petitioner, had become pregnant. Submission has been advanced by the learned counsel for the petitioner that the victim was already carrying pregnancy prior to she being raped by the petitioner. It has been submitted that the petitioner is in custody since 02.09.2025. Learned A.P.P. has opposed the prayer for bail of the petitioner. Regard being had to the specific nature of allegation levelled against the petitioner, I am not inclined to grant bail to the petitioner. His prayer for bail is hereby rejected.
