Choudhury, learned counsel for the accused applicants and Mr. K. K. Parasar, learned Additional Public Prosecutor for the State. 2. This is an application under Section 482 of the BNSS, 2023 praying for granting pre-arrest bail to the accused applicant in connection with Sadiya P.S. Case No. 117/2025 under Section 108 of the BNS, 2023. 3. The allegations made in the FIR are to the effect that two persons, who are father and son, had abetted the suicide of the husband of the informant. The FIR also refers to a suicide note which was attached thereto, however, the same is not on record. 4. Ms. Devi, learned counsel for the accused applicants, submits that in terms of the interim order dated 21.01.2026, accused applicant No. 2, namely, Shri Manas Chetia, has already appeared before the Investigating Officer. She further submits that since the Charge-Sheet, being Charge-Sheet No. 06/2026 dated 25.01.2026, has already been filed in the instant case, this Court may permit both the accused applicants to remain on bail so that they can appear before the Trial Court. 5. Perused the Charge-Sheet, being Charge-Sheet No. 06/2026 dated
25.01.2026. 6. After considering the matter in its entirety, this Court is of the considered opinion that the interim protection granted earlier on 21.01.2026 to accused applicant No. 2 should be made absolute. Accordingly, the same is hereby made
Page No.# 3/3 absolute till his appearance before the learned Trial Court. 7. Insofar as the accused applicant No. 1, namely, Shri Lakhin Chetia, is concerned, this Court is of the view that accused applicant No. 1 should be granted the privilege of pre-arrest bail at this stage, till his appearance before the learned Trial Court. 8.
Accordingly, it is directed that, in the event of the arrest of the accused applicant No. 1, namely, Shri Lakhin Chetia, in connection Sadiya P.S. Case No. 117/2025, he shall be released on bail upon furnishing a bail bond of Rs. 30,000/- (Rupees Thirty Thousand) with one surety of like amount to the satisfaction of the learned Judicial Magistrate (M) Sadiya, Chopakhowa, Assam subject to the following conditions: i. that both the accused applicants shall appear before the learned Judicial Magistrate (M) Sadiya, Chopakhowa, Assam on the next date of their appearance; ii. that both accused applicants shall cooperate with the trial and appear before the Trial Court as and when called for; iii. that both accused applicants shall not try to hamper or tamper with evidence or influence the witnesses. 9.
