This is an application under Section 482 of BNSS, 2023, for granting pre- Page No.# 2/3 arrest bail to the accused/petitioner, namely Miss Barnali Narah in connection with Sualkuchi Police Station Case No. 33/2026, registered under Sections 143(2)/ 127(2)/ 318(4) of the BNS, 2023. 3. The brief facts of the case is that in reference Sualkuchi PS GDE No- 05 dated 09.06.2026, a written petition has been submitted by Purabi Das, W/O - Sri Hari Das, R/O. - Kaibartapara, PS - Sualkuchi, Dist - Kamrup, Assam, M/No - 6003378461, to the effect that for about the past month, the informant's daughter, Runima Das, used to frequently stay at the house of the alleged person Sri Mahima Das, W/O - Bulen Das, R/O - Kaibartapara, PS - Sualkuchi, Dist - Kamrup, Assam. When the informant asked her daughter about it, she said she liked being there for no specific reason. On 06.06.2026 at around 11:00 AM, her daughter, along with Rinki Das (daughter of Kusum Das from the nearby Kaibartapara village), were sent out from her house on the pretext of providing them with medical-related jobs; instead, they were kept locked inside a room in a house at Ganeshguri by a woman and a man. When both girls did not returned home by evening, a few young men from her village went to Page No.# 3/4 Guwahati to search for them and they successfully rescued both girls from inside the room in Ganeshguri, Guwahati. 4. It is submitted that the petitioner is not named in the FIR and she is the owner of an NGO called Home Care Society, which is registered with the authorities and the purpose of the NGO is to provide home care facilities by supplying persons to take care of patients in their homes and in this connection, the NGO receives girls sent by their families for the purpose of employment. 5. Pursuant to notice under Section 35, BNSS received from the I/O, the Page No.# 3/3 petitioner had previously appeared before the I/O and her statement was also recorded. Subsequently, she received another notice but she could not appear before the I/O due to ill health. 6. The case diary as called for has been received and perused. 7. It appears that pursuant to the interim protection granted by order dated 18.06.2026, the petitioner has appeared before the I.O. and her statement has also been recorded. 8. On perusal of the case diary, it does not appear to be any incriminating materials warranting custodial interrogation of the petitioner. Accordingly, prayer for pre-arrest bail is allowed. The interim order dated 18.06.2026 is hereby made absolute on the same terms and conditions as noted in the interim order itself as may be applicable as on today. 9.
