This bail application has been filed by the petitioners namely, (1) Rajul Ali and (2) Ruhit Baishya @ Rohit Baishya under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking regular bail in connection with Dispur P.S. Case No. 279/2026 registered under Sections 126(2)/ 118(2)/ 3(5) of the BNS, 2023. 3. The petitioners were arrested on 11.05.2026 and spent 65 days in custody. The alleged offence is under Sections 126(2)/ 118(2)/ 3(5) of the BNS, 2023. The statutory period of detention in respect of the aforesaid offence is 60- days. 4. Hence, the petitioners are entitled to default bail in view of the decisions of the Hon’ble Apex Court in the case of Rakesh Kukar Paul Vs. State of Assam, reported in (2017) 15 SCC 67. 5. The learned Addl. P.P. has submitted that the case diary is lying in the Court of the learned CJM, Kamrup (Metro), Guwhati which indicates that the charge sheet has not been submitted till date. 6. Accordingly, the petitioners named above shall be released on bail on furnishing a bond of Rs. 20,000/- (Rupees twenty thousand) only each with two sureties each of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro), Guwahati in connection with the aforementioned case. 7. The direction for bail is further subject to the following conditions that: (i) the petitioners shall cooperate with the trial of the case regularly and they shall not try hamper the investigation or tamper with the evidence of the case; and Page No.# 3/3 (ii) the petitioner shall not try to influence or intimidate any person or the remaining witnesses, who are acquainted with the facts of the case, in any manner. 8.
