JUSTICE RAJNESH OSWAL, JUDGE ORDER(ORAL) Arun Palli -CJ Learned Senior counsel for the petitioner submits that vide Government Order No. 1347-UD of 1975 dated June 11, 1975, the permission was accorded for construction of Hotel building, namely, Lake Isle Resort. And the said Hotel was registered with the competent Authority under the Shops & Establishment Act as also with the Department of Tourism. He submits that the subject property was acquired by the petitioner (Amber Ahmad) and was accordingly reflected in his name in the revenue records. But, unfortunately the said property got damaged in the floods of September, 2014. And subsequently owing to a heavy snow fall on 4th/5th January, 2021, the hotel building was further damaged. So much so, a formal FIR as regards damage to the hotel property was registered on January 05, 2021. It is submitted that the petitioner Sr.No. 16 WP(C) No. 742/2026 Page 2 of 2 had applied to the competent authority for grant of permission to carry out necessary repairs/reconstruction, but despite the matter being pending for a considerably long time, has shown no tangible progress. As to this, learned counsel for the respondents, on instructions, submit that the claim of the petitioner shall be placed for consideration and necessary orders in the meeting of the Building Operation & Controlling Authority, which is scheduled in the immediate future. That being so, learned Senior counsel for the petitioner submits that, for the present, let the petition be disposed of in terms of the statement made by learned counsel for the respondents. He submits that to avert any avoidable delay, the petitioner would still move to the respondent-Authorities to apprise him of the deficiency, if any, in his documents to consider his claim. However, he submits that the petitioner be granted liberty to move an appropriate application in this petition itself, just in case the authorities still fail to consider his case within a reasonable time or the meeting of the Building Operation & Controlling Authority is not convened. In the wake of the above and in terms of the statement made by learned counsel for the parties, the petition is, accordingly, disposed of with the liberty prayed for.
