Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That, the Hon’ble Court may kindly be pleased to issue a writ of mandamus and quash the impugned transfer order dated 08.04.2026 (Annexure P-1) issued by the Office of the Chief Executive Officer of the Zila Panchayat Kanker District Kanker, in the interest of justice. 10.2 That, the Hon’ble Court may kindly be pleased to issue a writ of mandamus and directing the Respondent No. 3 to consider the petitioner’s representation dated 16.04.2026 and reinstate the petitioner to her original place of service ie., village PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA Date: 2026.04.28 19:07:14 +0530 2 / 3 panchayat Lakhanpuri Janpad Panchayat Koylibeda District Kanker, for furtherance of justice. 10.3 Any other relief/ reliefs which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case with cost of the petition may also please be granted to the petitioner, in the interest of justice.” 2. Learned counsel for the petitioner submits that petitioner who is working as Panchayat Secretary and is posted at Village Panchayat, Lakhanpur, District Kanker is transferred to the Village Panchayat, Tadbayli, Janpad Panchayat Koylibeda, North Baster- Kanker by way of impugned order dated 08.04.2026 (Annexure P-1). Transferred place of posting of petitioner is about 43 kms away from earlier place of posting and it is a sensitive area. He also contended that petitioner is a lady and she will face difficulty to travel 43 kms for discharge of her duties. Petitioner is having children studying in school at Pakhanjur which is near to the earlier place of posting. Petitioner has already submitted a representation before Respondent No. 3 on 16.04.2026, which is pending consideration and therefore direction be issued to Respondent No. 3 to consider and take decision on the representation of petitioner at the earliest within specified time. He also submits that till date petitioner is not relieved and therefore direction be also issued not to relieve the petitioner till decision is taken on representation. 3. Learned State counsel submits that grievance of petitioner is against Respondent No. 3 for whom she is not appearing. 4. I have heard learned counsel for the respective parties. 5. On due consideration of the submission of learned counsel for the respective parties, and further that nature of grievance which is raised by the petitioner, Respondent No. 3 will be appropriate authority to 3 / 3 consider and appreciate, this writ petition is disposed off with a direction to petitioner to place order of this Court before Respondent No. 3, within a period of 10 days, and thereafter Respondent No. 3 is directed to consider and take decision on the representation dated 16.04.2026 submitted by petitioner, within outer limit of 02 weeks from the date of receipt of order passed by this Court. 6. Till decision is taken on the representation of petitioner, status quo as it exits today with respect to place of posting of petitioner shall be maintained by the parties. 7.
