THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 25924 OF 2026 The Court made the following order:
This Writ Petition is taken by way of ‘Lunch Motion’. 2.

This Writ Petition is filed under Article 226 of Constitution of India seeking Writ of Mandamus declaring the highhanded, arbitrary and illegal action of the respondents in surveying the land of the petitioner admeasuring to an extent of Ac.2.20 cents in Sy.No.33/2 of Thonduru Village, Varadaiahpalem Mandal, Chittoor District utterly disregarding the pending civil disputes and under the guise of the said survey, highhandedly proceeding to uproot the 30 year old mango trees and changing the physical features of the land without issuance of any notice or any intimation at the behest of 12th, 13th and 14th respondents and consequently direct the Respondents not to interfere with the peaceful possession and enjoyment of the Petitioner over Ac.2.20 cents in Sy.No.33/2 of Thonduru Village, Varadaiahpalem Mandal, Chittoor District. 3. Learned counsel for the Writ Petitioner submits that the respondents are proceeding to survey the land of the petitioner admeasuring in an extent of Ac. 2.20 cents in Survey No.33/2 of Thonduru Village, Varadaiahpalem Mandal, Chittor District without following the due process as contemplated under the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923. He further submits that on the guise of survey, the respondents are trying to dispossess the petitioner from the subject land and also cutting the Mango trees which are planted at the subject land, in contrary to law and Principles of

Natural Justice and requested this Court to dispose of this Writ Petition by directing the respondents not to dispossess the writ petitioner and not to cut down the trees, without following due process of law. 4. On the other hand, learned Assistant Government Pleader for Revenue submits that the respondents would adhere to the Principles of Natural Justice and follow the due procedure as contemplated under the provisions of Andhra Pradesh Survey and Boundaries Act, 1923. 5. Having considered the submissions of both counsels, this Court deems it appropriate to dispose of this Writ Petition at the admission stage, without going into merits, by directing the concerned Respondents not to proceed with the survey without following the procedure as contemplated under Section 21 of the Andhra Pradesh Survey and Boundaries Act, 1923. It is needless to state that the Respondents are obligated to adhere the Principles of Natural Justice while proceeding further in surveying the lands of the writ petitioner. 6. With these observations and directions, this Writ Petition is disposed of.
