The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of an appropriate writ order in the nature of certiorari for setting aside the action of the respondents whereby the gratuity and commutation of pension of the petitioner have been illegally withheld on account of pendency of show cause notices dated 12.10.2012, Annexure P-2, 10.08.2023, Annexure P-7 and 23.11.2023, Annexure P-10, without issuance of any charge-sheet or conclusion of departmental proceedings, in violation of Regulation 12-3.A of the UHBVN-2005 Regulations and the principles of natural justice. Mr. Prince Singh, Advocate has put in appearance on behalf of the respondent-Nigam accepts notice and on instructions from Mr. Ranbir Deswal, XEN, OP City Division, Sonipat, submits that the show cause notice issued to the petitioner has been dropped and all his retiral dues including gratuity, commutation of pension and 2nd and 3rd ACP benefits will be released within a period of six weeks. 4. The learned counsel for the petitioner submits that he is satisfied with the stand taken by learned counsel for respondent-Nigam. However, he submits that petitioner retired on 31.12.2024 and on account of delay he is entitled for the interest on the delayed payment in the light of the judgment rendered by the Full Bench of this Court in A.S. Randhawa, Superintending Engineer (Retd.) vs. State of Punjab, 1998 (1) SCT 343, wherein it has been unequivocally held that any delay in release of pensionary or retiral benefits beyond a reasonable period of two months from the date they become due would entail payment of interest to compensate the retiree for such delay. 5. In view of the stand taken by learned counsel for the respondents, the present writ petition is disposed of with a direction to respondent-Nigam to pay all the admissible retiral dues including gratuity, commutation of pension and 2nd and 3rd ACP benefits along with interest @ 6% to be calculated after PARUL VERMA 2026.04.09 13:53 I attest to the accuracy and authenticity of this order/judgment. 3 CWP-10190-2026 two months from the date of retirement till its actual realization in terms of A.S.
