Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ or order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents herein particularly Respondent No.2 to 4 in not accepting the request made by the Petitioner along with other members of the Fishermen Co- operative Society Limited of Doddigunta village, Rangampeta Mandal, Rajamahendravaram District, Erstwhile East Godavari District in change of Police Officers of l)Rangampeta 2)Anaparthi 3)Bikkavolu 4)Pedapudi and to engage other police officers of other Mandal in conduction of Election to the Doddigunta Fishermen Co-operative Society Limited of Rangampeta Mandal, East Godavari District in the ensuring elections scheduled on 29.04.2026 basing on the proceedings issued by the Respondent No.2 vide Progs. THE HON’BLE SRI JUSTICE SUBHENDU SAMANTA WRIT PETITION NO: 11890/2026 ORDER:
1. The petitioner is a member of the Doddigunta Fishermen Cooperative Society Limited. The election of the said Society was supposed to be conducted on 05.03.2026. The petitioner, under apprehension of unfair election process, approached this Court by filing W.P.No. 6023 of 2026. This Court, upon considering the prayer of the petitioner, has passed an order dated 02.03.2026, directing the authority concerned to take appropriate steps so that free, fair and transparent election can be conducted. However, the facts suggest that the election could not be conducted on 05.03.2026, it is supposed to be conducted on 29.04.2026. The petitioner is under apprehension that as this Court while disposing of W.P. No.6023 of 2026 directed the concerned authority to conduct election on 05.03.2026 in free, fair and transparent manner, the same may not be followed if it held on 29.04.2026. 2. I make it clear that the direction upon the respondent authority is very general to conduct the election in a free, fair, and transparent manner. 3. Learned counsel for the parties frankly submit that the same directions may be passed in respect of election dated 29.04.2026. -4- W.P. No.11890 OF 2026
4. Accordingly, the present writ petition is disposed of following direction of this Court passed in W.P.No.6023 of 2026 only reading the date of 05.03.2026 to be 29.04.2026.
I further make it clear that the authority concerned shall conduct the election to be held on 29.04.2026 in a free, fair, and transparent manner. 5.
