VAMSI KRISHNA NOBLE SCHOOL, REP ITS PRINCIPAL/CORRESPONDENT, DHARMAVARAM, SRI SATHYA SAL DISTRICT, ANDHRA PRADESH.515671 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toissue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of Respondent Nos. 2 to 4 in withholding the Transfer Certificate and educational records/documents of Ms. Himavarshini, who has successfully completed Class X, on the ground of alleged pending fee dues of her younger sister, as arbitrary, illegal, unreasonable, discriminatory and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the 4th respondent to forthwith issue the Transfer Certificate of Ms. Himavarshini along with all her educational records, certificates and documents required for her admission into First Year Intermediate, without insisting upon payment of the alleged fee dues relating to the petitioner's younger daughter as a condition for issuance of the Transfer Certificate permit the petitioner reasonable time to address and, if found legally payable, discharge any legitimate fee dues relating to the younger daughter, without making payment of such alleged dues a condition 2 for issuance of the Transfer Certificate and educational records of the elder daughter, direct Respondent Nos. 1 to 3 to ensure strict compliance with the above directions and to take all necessary steps to protect the academic interests of Ms. Himavarshini, direct the 5th respondent not to cancel or otherwise disturb the admission of Ms. Himavarshini in First Year Intermediate (Bi.P.C.) merely on account of the delay or non-production of the Transfer Certificate caused by the refusal of the 4th respondent to issue the same, direct that Ms. Himavarshini shall not be subjected to any late fee, fine, penalty, loss of admission, loss of academic year or any other adverse consequence attributable solely to the refusal/delay of the 4th respondent in issuing the Transfer Certificate and educational records, direct the competent educational authorities to conduct a detailed enquiry into the conduct and functioning of the 4th respondent school, including the withholding of the Transfer Certificate and educational records of the petitioner's daughter on the ground of alleged fee dues of another student/family member, and into any other violations of the applicable educational rules, regulations and statutory requirements direct the competent authorities, upon completion of such enquiry and upon finding any violation, illegality, misconduct or breach of the applicable educational rules and regulations, to take appropriate consequential action against the 4th respondent school, including cancellation/withdrawal of recognition or permission and closure of the school, if warranted in accordance with law, after following due process IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Direct the Respondent School/Respondents to forthwith issue and hand over the Transfer Certificate, Study/Bonafide Certificate, Marks Memo and all other educational records of the Petitioner's daughter, Ms. T.Himavarshini, without insisting upon payment/clearance of the alleged fee dues of her younger sister, and further direct the concerned Respondents/Intermediate College to permit and facilitate her admission into the First Year Intermediate Course for the academic year 2026-27, notwithstanding expiry of the admission schedule on 17.08.2026, and to accept her admission documents/complete the admission process, subject to the final outcome of the Writ Petition, Counsel for the Petitioner: 1.
