This bail application has been filed on behalf of Mithilesh Kumar @ Mithilesh Ram who is in custody since 28.10.2025 in connection with Jamua P.S. Case No. 257 of 2025 for the offence registered under Section 64(1) of the BNS pending in the Court of learned Judicial Magistrate 1st Class, Giridih, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that victim is major married lady and it has come during investigation that physical relationship was consensual in nature. After both were found to be closeted in a room and hue and cry was raised, only then the victim lady alleged that she had been sexually assaulted. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
