Also heard Mr. Kuldip Baishya, learned Additional Public Prosecutor, Assam, for the State respondent. 2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for granting of pre-arrest bail to the petitioner namely, Sri Bibhuti Pathak, in connection with Mushalpur P.S. Case No.
Page No.# 2/3 3/2026 under Section 126(2)/ 117(2)/ 118(1)/ 109/ 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The allegation as reflected in the FIR on 24.01.2026 during the night time, the victim was assaulted by certain persons, one of who was allegedly the present petitioner, as a result of which the victim sustained grievous injuries to his head. 4. The petitioner was granted interim protection by this court vide order dated 27.02.2026 pursuant to which he appeared before the I.O. and his statement was also recorded. Subsequently, the investigation has been completed and charge sheet has also been submitted and the petitioner had appeared before the learned Court below and was allowed to go on bail in view of the order of the interim pre-arrest bail granted by this Court. 5. The scanned copy of the TCR has been received and perused. Although the medical report indicates the grievous head injuries, having regard to the fact that the investigation has been completed by now, there would not be any necessity of remanding the petitioner to the custody at this stage. 6.
Accordingly, the prayer interim bail dated 27.02.2026 is hereby made absolute subject to the conditions that:-
(i) the petitioner shall make himself available for interrogation by the Investigating Officer as and when required; (ii) the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case
Page No.# 3/3 so as to dissuade him from disclosing such facts to the Court or any other police officer, and (iii) the petitioner shall not hamper with the investigation or tamper with the evidence of the case. 7.
