The petitioner herein has prayed for quashing of the proceeding being G.R. case no. 2086 of 2025, presently pending before the learned Additional Chief Judicial Magistrate, Sealdah. The allegation levelled in the written complaint is that some unknown persons impersonating themselves as officials of the State Bank of India induced the complainant to download a link, resulting in an alleged withdrawal of Rs. 1,30,999/- from his bank account. During pendency of the proceeding, the parties have amicably settled their dispute and to that extent, they have filed on connected application being CRAN 1 of 2026.
Learned counsel for the opposite party no. 2/complainant submits that in view of the amicable settlement, the opposite party does not want to proceed further with the said proceeding and he has decided not to adduce evidence in support of the imputations
2 levelled against the present petitioner as he has already received the amount.
Learned counsel for the State placed the case diary and also submitted a report sent by Officer-in-charge, Cossipore Police Station dated 12.4.2026 which also discloses that the parties have amicably settled their dispute and the complainant has also received a portion of the money and therefore, the complainant does not want to proceed with the case any further. Having considered the submissions made on behalf of all the parties, it appears to me that the defacto-complainant has decided not to support the imputations levelled against the present petitioner in view of the amicable settlement and as such, there is hardly any chance of conviction at the end of trial. Therefore, further continuance of the instant proceeding against the present petitioner will be mere abuse of the process of the court. In such view of the matter, CRR 1289 of 2026 is allowed. The impugned proceeding being G.R. case no. 2086 of 2025, presently pending before the learned Additional Chief Judicial Magistrate, Sealdah is hereby quashed qua the petitioner, Sony Manna. Connected application, if any, is also disposed of. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
