1. The present bail applications have been filed by the accused- petitioners under Section 483 of B.N.S.S. in connection with F.I.R. No.01/2026 registered at Police Station Cyber Police Station (Jhunjhunu), District Jhunjhunu, for the offence(s) punishable under Section(s) 316(2) & 318(4) BNS and Section 66D of IT Act.

Learned counsel for the petitioners submits that the accused- petitioners have been falsely implicated in the case and they have

Learned counsel further submits that the parties have amicably settled their dispute by way of compromise and there does not remain any controversy between them. Learned counsel also submits that in pursuance of the compromise, the alleged amount of Rs.1,95,000/- and Rs.3,00,000/- has already been returned by the petitioners, namely Pravindra Kumar and Krishan Kumar respectively, to the complainant.
3. Learned counsel further contends that the other co-accused person, namely Vikas Singh, has already been enlarged on bail by this Court, vide order dated 10.02.2026, in S.B. Criminal Miscellaneous Bail Application No. 2486/2026. Learned counsel also submits that the petitioners are in custody since long time; no further recovery is required to be made from them; the case is triable by a Court of Magistrate and trial will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioners in custody, therefore, the benefit of bail under Section 483 B.N.S.S. may be granted to the accused- petitioners.
4. Per contra, learned Public Prosecutor opposes the
submissions made by learned counsel for the petitioners hereinabove.

Learned counsel for the complainant does not dispute the factum of compromise arrived at between the parties and submits that the complainant has no objection if the petitioners are released on bail in view of the compromise arrived at between the parties.

6. Heard learned counsel for both the parties and perused the material available on record.

Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, the fact that the case is triable by a Court of Magistrate, the parties have amicably settled their dispute by way of compromise and trial will take considerably long time to conclude, thus, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail.

Therefore, the bail applications under Section 483 B.N.S.S. are allowed and the accused-petitioners, namely Pravindra Kumar S/o Late Mahendra Singh and Krishan Kumar S/o Kanaram, are ordered to be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the Trial Court, with the stipulation that the petitioners shall appear before that Court on all subsequent dates of hearing and as and when they are called upon to do so.
