Learned counsel for the petitioner would submit that State Police Academy has passed the recovery order to the tune of 1,08,383/- from the salary of the petitioner without ₹ affording opportunity of hearing which is unsustainable and bad in law, therefore, petition is liable to be allowed. 3. Learned State counsel would oppose the prayer made by learned State counsel and support the impugned recovery order. 4. I have heard learned counsel for the parties, considered their rival submissions made herein above and gone through the records with utmost circumspection. 5. Admittedly, the recovery order was passed by the Superintendent of Police, Police Academy Chandkhuri, District Raipur, without affording opportunity of hearing to the petitioner, therefore, impugned recovery order dated 19.06.2017 (Annexuure P/1) is set aside. However, State Police Academy, Chandkhuri, District Raipur, is at liberty to pass fresh order after affording the opportunity of hearing to the petitioner. 6.
