ORAL ORDER
The petitioners are before the Court seeking the following prayers: i) Call for L.C.R in Crime No.76/2023 of Nelamangala town police station which is now pending on the file of the 2nd Additional Civil Judge & J.M.F.C Court, Nelamangala

for the offences punishable under sections 406 & 420 of IPC. ii) Quash The FIR agums the Goe petitioner in Crime No.76/2023 of Nelamangala town police station which is now pending on the file of the 2nd Additional Civil Judge & J.M.F.C Court, Nelamangala for the offences punishable under sections 406 & 420 of IPC. iii) Pass any other order/s as deems fit in the facts and circumstances of the case in the interest of justice. 2. During the subsistence of the proceedings parties to the lis have settle the dispute among themselves. 3. The petitioner-accused No.2 is present before the court and he would accept the settlement arrived at between the parties. The complainant-respondent No.2 is also present before the Court and would again admit that the settlement has happened between the parties and all the conditions of settlement are fulfilled and the terms of settlement read as follows:
"The petitioner above named begs to submit as follows:-
That for the reasons sworn to in the accompanying affidavit that this Hon'ble Court be pleased to permit the Petitioner and the Respondent No.2 to compound the offences punishable under sections 406 & 420 IPC of Nelamangala Town Police on the file of the 2nd Addl. Civil Judge and JMFC, Nelamangala and quash the entire proceeding in the interest of justice. - 5 -

We, 1) Naveesh Chandrappa, S/o Chandrappa.N, Aged about 42 years, Beeramanahalli, Kasaba Hobli, Kolar Taluk & District-563101, 2) Chandrappa.M, S/o Late. Muniyappa.V, Aged about 69 years, Beeramanahalli, Kasaba Hobli, Kolar - 563 101, 3) O.S.Venkatesh, S/o O.S.Sathyanarayana Setty, Aged about 54 years, R/at No.404, Sun Rice School, Subhash Nagara, Nelamangala Town, Bengaluru Rural Dist-562 123, now at Bengaluru, do hereby solemnly affirm and state on oath as follows;

1 Chandrappa.M who is the petitioner in Crl.Pet No.4947/2023 | am the father of Naveesh Chandrappa who is the Petitioner in Crl Pet No.5911/2023 has authorized me to swear this affidavit on behalf of him for the reason that he has sustained leg fracture and he is unable to appear before this Hon'ble Court today. 2. 1, O.S Venktesh, Deponent No.2 had initiated proceedings against the Naveesh Chandrappa and Deponent No.1 for the offences punishable under sections 406 & 420 IPC and the same is pending in Crime No.76/2023 of Nelamangala Town police now pending on the file of the 2nd Additional Civil Judge and JMFC, Nelamangala. 3. We submit that, the aforesaid dispute arose out of certain business/financial transactions between the parties. The same was purely private in nature and does not affect public peace or public interest. 4. We submit that, with the intervention of elders, well- wishers and on legal advice, we have amicably resolved the dispute in order to maintain cordial relations and to retain their business relationship. 5. Pursuant to the settlement, Naveesh Chandrappa (Petitioner in 4947/2023) has paid a sum of Rs. 91,50,000 (Rupees Ninety One Lakhs Fifty Thousands only) to Deponent No.2 by way of Demand Draft No. 520272 dated 02.02.2026 drawn on Union Bank of India
6 And a sum of Rs. 27,45,000/- (Rupees Twenty Seven Lakhs Forty Five Thousands only) to Deponent No.2 by way of Demand Draft No. 044720 dated 25.02.2026

drawn on Axis Bank, towards full and final settlement of all claims arising out of the above crime. 7. 1 Deponent No.2 hereby acknowledges receipt of the aforesaid amount and declares that he has no further claims of any nature whatsoever against Naveesh Chandrappa & Deponent No. 1 in respect of the subject matter of Crime No.76/2023. 8.
I the, Deponent No.2 does not wish to prosecute the case any further and prays this Hon'ble Court for compounding of the offences and for quashing of the FIR and all further proceedings in Crime No.76/2023 pending against Naveesh Chandrappa and Deponent No.1 which is pending before the 2nd Additional Civil Judge and JMFC, Nelamangala. 9. We submit that, in view of the amicable settlement, continuation of the criminal proceedings would serve no purpose and would only result in abuse of the process of law. 10. We the deponents jointly pray that this Hon'ble Court may be pleased to record the settlement, compound the offences, and quash Crime No.76/2023, of Nelamangala Town Police Station for the offences punishable under Sections 406 & 420 of IPC, in the interest of justice and equity. WHEREFORE, we pray that this Hon'ble court be pleased to allow the accompanying application in the interest of justice. We, the deponent do hereby declare that what is stated above is true and correct to the best of our knowledge, information and belief and this is our signatures. 4. In light of the settlement arrived at between the parties, the application seeking compounding of the offence

stands accepted and the proceedings is closed against the petitioners. 5. In view of the above, I pass the following:
ORDER i. Criminal Petitions are disposed. ii. Impugned FIR in Crime No.76/2023 registered by Nelamangala Town Police Station, against the petitioners, stands quashed.
