The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 304B, 34 IPC in connection with S.T Case No. 457 of 2024 arising out of Sitaramdera PS Case No. 32 of 2024 corresponding to G.R Case No. 632 of 2024. In this case, charge has been framed under Sections 498A, 304B/34, 302 IPC and under Section 3/4 of D.P Act. 3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. It is submitted that the petitioner is husband and cause of death of deceased is asphyxia due to hanging and the doctor, who has been examined as PW11, has conducted the postmortem and deposed that death is suicidal in nature. Learned counsel for the petitioner further submits that only two witnesses are left to be examined and the witnesses who have been examined have not deposed demand of dowry and the petitioner is in custody since 22.04.2024. As such, learned counsel for the petitioner submits that the petitioner may be enlarged on bail. 4. Learned APP opposes the prayer for bail of the petitioner. 5. Having regard to the deposition of doctor who has been 2026:JHHC:7780 2 examined as PW11 coupled with the deposition of other independent witnesses to the effect that the relationship between victim and the petitioner was cordial and the petitioner is lying in judicial custody since 22.04.2024, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VII-cum-Fast Track Court, Special Court, (CAW), Jamshedpur in connection with S.T Case No. 457 of 2024 arising out of Sitaramdera PS Case No. 32 of 2024 corresponding to G.R Case No. 632 of 2024. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner. 7.
