Learned State Counsel submits that petitioner is the encroacher of subject land and order of eviction has already been passed by the concerned Tahsildar on 07.08.2021 (Annexure P-1) and same has further been confirmed vide order dated 31.08.2021 (Annexure P- 2) by the concerned Sub-Divisional Officer and, thereafter, against 2 the order, the concerned Commissioner has also passed an order confirming the order of the Tahsildar for eviction from the suit property. Petitioner is encroacher and he is not any legally enforceable right, as such, on merits petitioner is not having any case in his favour. 2. Considering the above aspects of the matter, particularly the fact that no one appears on behalf of the petitioner and further considering this aspects that no interim order has been passed in favour of the petitioner, as such, it appears that order of eviction passed by the Tahsildar which has been confirmed by the concerned SDO as well as the Commissioner has attained its finality, hence, present petition seems to be rendered infructuous. 3.
