...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction, more particularly one in the nature of a WRIT OF MANDAMUS (a) declaring the inaction, failure and refusal of the Respondents Nos. 3 to 7 to conduct a re-survey and demarcation of the common boundary between the land of the Petitioners and the land of the Respondents Nos. 9 and 10 in Sy. No. 2456-1 (Sy.
No. 2456-1C2) of Sarvepalli Bit-ll Village, Venkatachalam Mandal, SPSR Nellore District, after due notice to and in the presence of the Respondents Nos. 9 and 10 as required by the Andhra Pradesh Survey and Boundaries Act, 1923, and their
inaction, failure and refusal to take any action whatsoever against the encroachment committed by the Respondent No. 9 in respect of an extent of Ac. 0.48 cents forming part of the said survey number, and in particular the Endorsement dated 10.04.2026 issued by the 5th Respondent in Rc.B.210/2026 read with Grievance Petition notwithstanding the concurrent official findings of encroachment recorded in the joint report of the Village Surveyor and the Mandal Surveyor dated 28.03.2026, the joint report of the Village Revenue Officer and the Mandal Revenue Inspector dated 31.03.2026 and the 5th Respondent's own report Rc.B/210(A)/2026 dated 15.04.2026, as illegal, arbitrary, unreasoned, without application of mind, amounting to a refusal to exercise the jurisdiction vested in them under the Andhra Pradesh Survey and Boundaries Act, 1923 and the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, and as violative of Articles 14, 21 and 300-A of the Constitution of India (b) and consequently to direct the Respondents Nos. 2 and 5 to 7, under the supervision of the Respondents Nos. 3 and 4, to take up and complete, within such time as this Hon'ble Court may fix, a re-survey, determination and demarcation of the common boundary between the Petitioners' land in Sy. No. 2456-1 (Sy. No. 2456-1C2) of Sarvepalli Bit-ll Village, Venkatachalam Mandal, SPSR Nellore District and the land of the Respondents Nos. 9 and 10, strictly in accordance with the provisions of the Andhra Pradesh Survey and Boundaries Act, 1923 and the Rules made thereunder (c) and further to direct the Respondents Nos.
3 to 7, upon such determination, to cause the fencing stones illegally erected in an L shape by the Respondent No. 9 within the Petitioners land to be removed and the survey and boundary marks to be restored at the cost of the Respondent No. 9 in exercise of the powers conferred by Section 15 of the Andhra Pradesh Survey and Boundaries Act, 1923, and to restore to the Petitioners the possession of such extent as may be found upon the said re survey to fall within their boundary, including the extent of Ac. 0.48 cents presently under the encroachment of the Respondent No. 9 (e) and further to 4 direct the Respondent No. 8 to register a First Information Report upon the Petitioners complaint dated 19.03.2026 and to investigate the same in accordance with law, and to render such police assistance and protection as may be necessary to protect the Petitioners peaceful possession and enjoyment of the schedule land and to enable the re-survey to be conducted peacefully upon the ground
IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the Respondents Nos. 5 to 7, under the supervision of the Respondent No. 4, to take up and complete a re-survey and demarcation of the common boundary between the land of the Petitioners and the land of the Respondents Nos. 9 and 10 in 3y. No. 2456-1 (Sy. No. 2456-102) of Sarvepalli Bit-ll Village, Venkatachalam Mandal, SPSR Nellore District, after due written notice to the Petitioners and to the Respondents Nos.

2. Notice to respondents 9 and 10, is dispensed with since no adverse
order affecting their rights or interests, is passed.

The above writ petition was filed to declare the inaction of respondents 2 to 7 in conducting re-survey and demarcation of the common boundary between the land of the petitioners and respondents 9 and 10, in survey No.2456-1 (Sy.No.2456-1C2), Sarvepalli Bit-II Village, Venkatachalam Mandal, SPSR Nellore District, as illegal and arbitrary.

Learned counsel for the petitioners would submit that the writ petition was filed on 20.08.2026. Thereafter, respondent No.5 issued notice to the petitioners and neighbouring owners on 25.08.2026 and conducted the survey on 29.08.2026. However, a copy of the report has not been furnished to the petitioner.
5. Given the developments pending the writ petition, since the survey was conducted on 29.08.2026, no cause survives for adjudication in the writ petition.
6. Hence, the Writ Petition is closed. This order will not preclude the respondent No.5 from furnishing copies of the report to the petitioners and the neighbouring owners as per the Rules. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
