Mr. Pankaj Miglani, learned counsel for respondent no.3. 4. The petitioner participated in a selection process pursuant to the advertisement dated 20.10.2023 issued by the respondent-selecting body inviting applications from suitable candidates for the post of Foreman Instructor. 5. It is the case of the petitioner that the petitioner participated in the said examination as an OBC category candidate. The selection process has now been completed on 14.11.2025 and the recommendation was sent by the selecting body to the department on 14.11.2025 along with 25% waiting list of the selected candidates in sealed cover. The appointments have already been made in the pursuance of the aforesaid selection/recommendation. Now the UKHC010149262026 2026:UHC:7694 petitioner submits that since one general category candidate has not accepted the appointment due to some reasons best known to him, therefore, the petitioner should be accommodated against the said vacancy, and he further submits that one of the candidates in the OBC waiting list shall be migrated to the general/open category and in his place the petitioner should be considered in the selection from the waiting list. 6. Since the entire selection process has been completed and the appointments have already been made by the respondent-State, therefore this Court is not inclined to interfere in the matter. 7. This much can be done that the petitioner can be permitted to make a fresh representation to the respondent no.1-Secretary, Department of Skill Development and Employment, Govt. Of Uttarakhand, Dehradun within a period of two weeks from today, and if such a representation is filed by the petitioner before respondent no.1 within the aforesaid period, the Secretary concerned shall take decision thereon strictly in accordance with law. 8.
