Learned counsel for the petitioner submits that as per the statements of the injured-Zubaida, grievous injury on her head is alleged to have been caused by the co-accused Meejan, who has already been granted indulgence of bail by this Court vide order dated 23.11.2022 in S.B. Criminal Misc. Bail Application No. 12836/2022. Counsel submits that only the presence of the petitioner, at the place of occurrence, has been alleged by the injured. Counsel submits that the case of the present petitioner is on better footing in comparison to the co-accused person. Counsel [2026:RJ-JP:24384] (2 of 3) [CRLMB-9200/2026] further submits that the petitioner is languishing in custody since 12.05.2026. Counsel further submits that the trial will take its own time to conclude, therefore, indulgence of bail be granted to the petitioner. 3. Per contra, learned Public Prosecutor opposes the prayer made by counsel for the petitioner and submits that the petitioner has absconded, hence, the charge-sheet under Section 299 Cr.P.C has been submitted against him. Under these circumstances, it is prayed that the petitioner does not deserve any indulgence of bail by this Court. 4. Heard and considered the submissions made at the Bar and perused the material available on record. 5. Considering the arguments put forward by learned counsel for the petitioner and looking to the fact that indulgence of bail has already been granted to the main accused- Meejan, against whom the allegation of causing fatal injury has been levelled by the injured and no specific overt-act has been assigned to the petitioner and also looking to the fact that the petitioner is in custody since 12.05.2026 and the trial will take its own time to conclude, therefore, without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS. 6.
