JUSTICE TARA VITASTA GANJU ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) 1. Heard the learned counsel appearing on either side. 2. A Compromise Petition dated 24.04.2026 filed by the parties under Order XXIII Rule 3 of the Code of Civil Procedure, 1908, is placed on record. The parties are present before the Court and are duly identified by their respective counsel. The compromise as recorded by the parties, is as under: “3. That, with the efforts of the family friends and well- wishers both the parties and concerned persons have decided to settle the dispute amicably. Accordingly, the respondent/his son Sri.K.V.Santosh Kumar and the appellant have settled the matter. The respondent/his son Sri.K.V.Santosh Kumar have agreed to pay Rs.25,00,000/- (rupees twenty five Lakhs Only) to the appellant. The appellant has agreed to close the above - 3 - HC-KAR NC: 2026:KHC:23204-DB RFA No. 950 of 2025 appeal i.e., R.F.A. No.950/2025 in the terms enumerated in this compromise petition and also agreed not precipitate to Cheque bounce case (C.C.No.454/2018) challenged in Crl.A.No.1085/2020 and agreed to return/hand over all the original documents if any in the possession of the appellant. 4. The respondent/his son Sri.K.V.Santosh Kumar has paid Rs.25,00,000/- (rupees twenty-five Lakhs) as mentioned below: a. Rs 5,00,000/- (Five Lakhs Only) on 1.7.2025 b. Rs 10,00,000/- (Ten Lakhs Only) on 11.8.2025 c. Rs 10,00,000/- (Ten Lakhs Only) on 26.11.2025 5. The appellant acknowledges the receipt of the above stated amount as full and final settlement from the respondent/his son Sri.K.V.Santosh Kumar. 6. The Appellant had agreed that he will not be claiming any rights what so ever in respect of the suit schedule property in future and acknowledges the absolute ownership of the Respondent who shall be declared as the absolute owner of the schedule Property.” 3. In the above view of the matter, the compromise petition is accepted. The appeal is disposed of in terms of the compromise entered into between the parties. 4. The Registry shall draw the decree accordingly. 5.
