[2026:RJ-JP:24744-DB] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR D.B. Review Petition (Writ) No. 24/2026 URN: WRW / 65U / 2026 Samiksha Sharma D/o Shri Ramakant Sharma, Aged About 29 Years, R/o Village And Post Bharli, Tehsil Baseri, District Dholpur. ----Petitioner Versus 1. The State Of Rajasthan, Through Principal Secretary, Department Of Education, Government Of Rajasthan, Secretariat, Jaipur 2. The Director, Elementary Education, Rajasthan, Bikaner. 3. Rishab Kumar Sharma S/o Shri Hariom Sharma (Merit No. WL-22095), Through District Elementary Education Officer, Dholpur. ----Respondents For Petitioner(s) : Mr. Jeetendra Kumar Sharma, Mr. Naresh Gupta For Respondent(s) : Mr. Chinmaya Saxena, Asst.G.C. with Mr. Sachin Rathore, AAAG on behalf of Mr. S. S. Naruka, AAG (for respondent Nos.1 & 2) HON'BLE THE ACTING CHIEF JUSTICE MR. SANJEEV PRAKASH SHARMA HON'BLE MR. JUSTICE MANEESH SHARMA Order 03/07/2026 One of the argument raised by learned counsel for the review petitioner is that the judgment passed by the Division Bench of this Court, Principal Seat at Jodhpur, in the matter of State of Rajasthan & Ors. Vs. Mohd. Barkat Khan & Ors.; D.B. Civil Special Appeal Writ No.477/2021, decided on 31.08.2022, would not be applicable here, as it does not take into consideration that the rule framed for the probationary sanctity is [2026:RJ-JP:24744-DB] (2 of 2) [WRW-24/2026] violated by the policy decision taken by the State Government of 25.02.2019. We find that such an argument cannot be examined for reopening a case which has been finally decided by exercising powers under the review jurisdiction. The powers of review have been clearly highlighted in the judgment passed by the Division Bench of this Court, Principal Seat at Jodhpur, in State of Rajasthan & Ors. (supra). Considering the limited scope of review available to us, we do not find any reason to review the order where there is no error committed by us apparent on the record. The present review petition is dismissed. All pending applications, if any, stand disposed of. (MANEESH SHARMA), (SANJEEV PRAKASH SHARMA),ACTING CJ 13/Seema
