By way of this petition, the petitioner has prayed for the following reliefs : 10.1 It is therefore prayed that, this Hon'ble Court may kindly pleased to issue a writ/order/directions to direct the respondents to release the amount of compensation of Rs.5,386,792 with interest to the petitioner, in the interest of justice. 10.2 Any other relief/reliefs, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case, may also please be granted to the petitioner. 3. Learned counsel for the respondent-NHAI submits that an application has been filed before the learned Arbitrator; consequently, the Arbitrator is now seized of the matter. 3 4. For the foregoing reasons, this Court is of the view that since an arbitration application has already been preferred by the NHAI authorities, the present petition cannot be entertained at this stage. 5. Accordingly, without entering into the merits of the case, the Writ Petition is disposed of with a direction to the parties to appear before the learned Arbitrator to raise their respective grievances in accordance with law.
