1. Mr. Gaurav Singh, learned counsel for the Applicant.

3. Present first bail application is moved by the applicant, who is in judicial custody in connection with FIR No.15 of 2025 dated 06.12.2025 under Section 109(1), 121(2) of Bhartiya Nyaya Sanhita (BNS) 2023, Police Station Khansyun, District Nainital.
4. Heard learned counsel for the parties.
5. Learned counsel for the applicant submits that applicant has been falsely implicated in the present case; there is no recovery from the applicant; there is no independent or public witness. Learned counsel for the applicant submits that except the statement of the co-accused there is no legally admissible evidence on record to prima facie establish the involvement of the applicant in the alleged firing incident. He further submits that applicant has no criminal history and is languishing in jail since
11.12.2025.
6. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
7. Accordingly, bail application is allowed. Let the Applicant-Yashod Singh be released on bail on furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the Court concerned.
