GP FOR HOME 3 The Court made the following ORDER: The Writ Petition has been filed for the following relief: “…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.3 to 5 in collusion with Respondent No.6 to 8, interfering with civil disputes and interfering with the peaceful possession and enjoyment of the Petitioners with regard to their Property admeasuring an extent of Ac.1.04 Cents in Old Sy.No.295/1, New Sy.No.295/1Bsituated at of Tiruchanuru Village, Andhra Pradesh and trying to dispossess the Petitioners, as illegal, arbitrary, violation of principles of natural justice and in violation of Articles 14, 21 and 300-A of the Constitution of India and Consequently direct the Respondent No.3 to 5 not to interfere with civil disputes, including interfering with the peaceful possession and enjoyment of the Petitioners with regard to subject properties in any manner, in the interest of justice and to pass such…” 2. Heard learned counsel for the Petitioners and the learned Assistant Government Pleader. 3. Mr. Devalaraju Anil Kumar, learned counsel for the petitioners, submits that respondent Nos. 3 to 5, in collusion with respondent Nos. 6 to 8, are interfering in the civil dispute and disturbing the peaceful possession and enjoyment of the petitioners with regard to their property. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that respondent Nos. 3 to 5 have not interfered in the civil dispute and are not interfering with the peaceful possession and enjoyment of the petitioners. 5. A learned Single Judge of this Court, in W.P. No. 20787 of 2024 dated 20.09.2024, directed the respondents therein not to dispossess the petitioners until further orders, and further directed all the parties not 4 to create any third-party rights, either by way of lease or by any mode of alienation, until further orders. In W.P. No. 20787 of 2024, directions were also issued for conducting a fresh enquiry by the Commissioner of Appeals for grant of Ryotwari Patta, which was earlier granted to the vendors of the petitioners. It was further directed that the Inam Deputy Tahsildar is permitted to proceed with the enquiry, but shall not pass any further orders until further orders are passed by this Court. 6. Having regard to the above mentioned directions and entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government pleader, the respondent Nos.3 to 5 are directed not to interfere with the civil disputes pending in between the petitioners and respondent Nos.6 to 8 without following due process of law. 7. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
